Fair Maps for Broome County Inc. Sues Broome County over Illegal County Legislative District Map

Gerrymandered map enacted by the Republicans in the county legislature and signed into law by the Democratic county executive violates New York State law.

Binghamton, NY — May 24, 2022 Today, Fair Maps for Broome County Inc. announced its lawsuit to throw out the illegal Broome County Legislative District map adopted this past January following the 2020 census. On behalf of six plaintiffs, Fair Maps for Broome County hired John L. Perticone, of Levene Gouldin & Thompson, LLP to ask the court to declare the Broome County Legislative Districts invalid. In this lawsuit, Fair Maps for Broome describes how the county legislature and county executive broke the law in an effort to gerrymander the county legislature for the benefit of the majority party. They did this by:

    • creating county legislative districts unequal in population and using the wrong population dataset;

    • dividing the Town of Maine into three districts in violation of the plain language of New York State law, which states that towns of that size “shall” not be divided;

    • adopting a map that was opposed by every member of the public speaking at the public hearings;

    • adopting a map unsupported by any expert opinion offered to the legislature; and

    • doing everything they could to preserve the Republican majority in the county legislature.

Fair Maps for Broome is asking the court to throw out the illegal and gerrymandered map and enable a process that follows the law and allows the residents of Broome County to have equal representation in their county legislature. Consistent with other lawsuits regarding state redistricting, this should be done prior to the 2022 elections.

As Janet Beal, Treasurer of Fair Maps for Broome Inc, put it: “The whole point of our representative government is that the people get a fair chance to choose the people who speak for them, and that applies to all levels of government. We shouldn't just focus on national elections, because local government is critically important in shaping the kind of community we are.” Matthew Johnson, President of Fair Maps for Broome Inc, added that “when this map was considered, members of the public, lawyers, and redistricting experts told county legislators and the county executive that it violated the law, but they approved it anyway. Now we are in the unfortunate position of having to sue our own county to overturn this gerrymandered map.”
